四、一九五八年六月三十日冰島宣布建立十二海里漁區，禁止外國漁船在區內捕魚。英國抗議，一九六一年三月十一日英國與冰島兩國換文，英國承認冰島的十二海里漁區，冰島同意將來漁區擴充至十二海浬 以外時，如發生争端將提交國際法院。一九七一年七月十四日冰島宣布自次年九月一日起將漁區擴至五十海浬，英國反對，因此在一九七二年四月十四日英國將此爭端提交國際法院。同年五月二十九日冰島通知法院，表示不接受法院的管轄權，且不願出庭應訴，冰島的主要論點是，在過去十年中，十二海浬的漁區逐漸被普遍承認，變化的法律環境(changed legal circumstances)使其當時付出的對價，即授與法院管轄權，以換取英國承認其十二海浬的漁區失效。請依照一九七三年國際法院對「捕魚管轄區案(法院的管轄權)」(Fisheries Jurisdiction Case, Jurisdiction of the Court，又譯為「漁權管轄案」)判決，說明法院針對上述冰島主張的見解與理由。
